Sheppard Cycles Warehouse Auction – Terms and Conditions

GENERAL TERMS AND CONDITIONS OF SALE.

  1. The auctioneer reserves the right to refuse any bid or withdraw any lot from the sale.
  2. The highest bidder will be the purchaser but if a dispute arises as to the last or highest bidder, the lot in dispute shall be submitted again provided the auctioneer cannot decide who was the last or best bidder. 
  3. No person will be allowed to retract his or her bid after being taken and the vendor reserves the right to bid either by the auctioneer or the vendors agent for any lot offered. 
  4. All purchasers shall, on the fall of the hammer, agree to purchase the lot of goods at the price of the winning bid on the specific lot. An invoice will be issues to the successful purchasers for their respective lots by the vendor, upon which the purchaser will be required to pay their invoices on the standard agreements of their account payment terms.
  5. All goods must be taken as they are. Neither the vendor nor the auctioneer will be liable for errors in description or quantities or any mis-description of the goods. No guarantees are offered as the goods being sold are given by the auctioneer or the vendors. Any deficiency in the quantity of the goods sold shall not invalidate the sale. The vendor or auctioneer shall not be bound to deliver more than is in their possession. 
  6. The whole of the lots having been available for review, no allowance or refunds will be made, nor will the buyer be permitted to reject any lot on the grounds of incorrect description in the catalogue. Sold lots are to be taken with all faults (if any) and will be at the buyers risk at the fall of the hammer and the neither the auctioneer or vendor shall be accountable for any deficiency, damage or loss which may arise thereafter. 
  7. The vendor will honour warranty claims made on any items sold through the auction, provided claimed are lodged through standard warranty processes.
  8. The vendor reserves the right to withdraw from sales agreements on lots containing Scott bicycles, if they are purchased by bidders who do not have Scott bicycles assigned to their purchasing accounts.
  9. The vendor will honour providing free freight on all lots sold via this auction.
  10. Additional special conditions may apply and will be announced at the commencement of any auction. It is accepted that when you bid for an item (at a sale where these terms and conditions are on display) you have read and understood and accepted the terms and conditions including special conditions and additional charges and/or taxes, of sale and therefore no correspondence — whether written or verbal, will be entered in to.
